Terms of Service

1. About these terms

This website (the "Site") is operated by UnD3ath (site owner) and Sout (co-founder), an individual business operating under the brand Aqua Sounds ("we", "us", "our"). By using the Site, creating an account, or purchasing or downloading any product, you agree to these Terms of Service ("Terms"). If you do not agree, please do not use the Site. You may contact us at any time at und3ath@aqua-sounds.top.

2. Accounts

• You must provide a valid email address and a password of at least 6 characters. You are responsible for keeping your credentials confidential and for all activity under your account.
• You must be at least 16 years old, or have permission from a parent or legal guardian.
• Notify us immediately at the address above if you suspect unauthorized use of your account. We may suspend or terminate accounts used for abuse, fraud, chargeback abuse or unlawful purposes.
• You may delete your account at any time by emailing us; see our Privacy Policy for what data is removed and what is retained.

3. Products and pricing

• Free products (e.g. the Askomp plugin) are provided at no charge and can be downloaded from the Site or our official repositories.
• Paid products (music releases, sample packs, software) are sold through our Merchant of Record, Creem (creem.io). Creem is the seller of record: it handles checkout, payment processing, invoicing, VAT/GST/sales tax, refunds and chargebacks. Prices are shown before you confirm a purchase and state whether tax is included.
• Streaming access on the Site (full-track playback for purchased works) is an accommodation tied to your account; it does not by itself grant a download of the audio files unless the product page states otherwise.
• We may add, change or discontinue products and adjust prices at any time. Changes never affect completed orders.
• Some pages link to third-party stores (e.g. Dizzylab, Afdian). Purchases there are governed by that platform's own terms; we are not a party to them.

4. Licenses

Unless a product page states different terms, purchasing or downloading a product grants you a personal, non-exclusive, non-transferable, worldwide license:

• to use the music in your own personal or commercial creative works (e.g. videos, streams, games), provided you do not claim authorship of the music itself;
• to install and use free software products (e.g. plugins) on machines you own or control, under the license distributed with the software (including its open-source license, where applicable);
• for sample packs: to use the samples in your own musical works, including commercial releases.

You may NOT: redistribute, resell, sublicense or share the files; upload them to content-ID or sample-matching services as your own; use the music to train generative models; or resell standalone copies of the audio. Registration-synced or mass Content-ID claims made by you against our own official releases are a material breach.

5. Playback and access

Purchased full-track playback is provided through your account and is limited to one concurrent stream per account. We may use technical measures (e.g. short-lived signed URLs) to prevent unauthorized sharing. If we suspend your account for breach of these Terms, access to purchased streaming may be suspended for the duration.

6. Refunds

For digital goods, refunds are handled by Creem in accordance with its buyer terms and applicable consumer protection law. If a download is defective, playback does not work as described, or a purchase was made in error, contact und3ath@aqua-sounds.top with your order reference and we will work with you and Creem to resolve it.

7. Intellectual property

All content on the Site — music, audio, software, artwork, text, logos and design — is owned by UnD3ath or its licensors and protected by copyright and other laws. The Aqua Sounds name and logo may not be used without prior written permission. If you believe content on the Site infringes your copyright, email us with a description of the work, the allegedly infringing URL and your contact details, and we will investigate and remove infringing material where appropriate.

8. Acceptable use

• Do not attack, overload, scrape at scale or attempt to gain unauthorized access to the Site or its infrastructure.
• Do not attempt to bypass purchase requirements, download gated content programmatically, or share account credentials publicly.
• Do not use the Site for unlawful content or purposes.

9. Disclaimers

The Site and free products are provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Site will be uninterrupted or error-free. Paid products are warranted only to match their description on the product page; otherwise the same disclaimer applies to the extent permitted by law.

10. Limitation of liability

To the maximum extent permitted by law, our total aggregate liability arising out of or relating to the Site or any product is limited to the amount you actually paid for the product concerned (or, if no purchase was made, the greater of the fees you paid in the 12 months before the claim or USD 10). We are not liable for indirect, incidental, special, consequential or punitive damages. Nothing in these Terms limits liability for death, personal injury, fraud or any liability that cannot be excluded by law, nor your statutory consumer rights.

11. Indemnity and termination

You agree to indemnify us against claims arising from your breach of these Terms or unlawful use of the Site. You may stop using the Site at any time; we may suspend or terminate your access for material breach (with notice where practicable). Sections 7, 9 and 10 survive termination.

12. General

If any provision of these Terms is found unenforceable, the remainder stays in effect. These Terms (together with our Privacy Policy) are the entire agreement between you and us regarding the Site. Payment-related disputes are handled by Creem as merchant of record under its buyer terms. We may assign our rights in connection with a merger or sale of the business.

13. Changes to these terms

We may update these Terms; the current version is always on this page with its "Last updated" date. Material changes will be announced on the Site. Continuing to use the Site after changes take effect means you accept the updated Terms.
